The website at hulaween.com and its subdomains, affiliated websites, and the Content (as defined below) and services available from or through hulaween.com (collectively “Site”) are made available by Hula V3 LLC, and its subsidiaries and affiliates (collectively, “Company,” “we” or “us” or “our”).

These Terms of Use (“Terms”) constitute a legal agreement between the user of the Site (“user” or “you”) and Company. It applies when a user accesses, uses or visits the Site. By visiting or using the Site, you expressly agree to these Terms, as updated from time to time. By submitting suggestions, reviews, or recordings (“User Content”), you grant Hula V3 LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your User Content in any media format. You represent that you own all rights to your User Content and have permission from any identifiable persons therein.

Ticket Terms and Conditions

Purchase or use of tickets to Suwannee Hulaween constitutes acceptance of these terms:

• Age Requirement: All Ages are allowed, anyone under 18 years of age must be accompanied by a parent or legal guardian. No refunds will be given for those denied entry due to our age policies.
• Revocable License: This ticket is a revocable license. We reserve the right to refuse admission or eject any person whose conduct is deemed disorderly or who fails to comply with event rules.
• Final Sale: NO REFUNDS OR EXCHANGES. All sales are final.
• Unauthorized Resale: Unauthorized resale is grounds for seizure and cancellation without compensation.
• Assumption of Risk: Holder assumes all risks incidental to the event, including inclement weather, and releases Hula V3 LLC, the venue, and performers from any claims arising from such causes.
• Media Release: You grant permission to utilize your image or likeness in connection with any live or recorded transmission or reproduction of the event.

Claims of Copyright Infringement (DMCA)

If you believe content on the Site infringes your copyright, you may send a notice to: [email protected]. The notice must include the information required by the Digital Millennium Copyright Act of 1998.

Links & Customer Communication

The Site contains links to other websites not operated by us; use them at your own risk. When you send emails to us at [email protected], you consent to receive communications from us electronically. Any comments or feedback you provide will become the exclusive property of Hula V3 LLC.

Disclaimer of Warranties & Limitation of Liability

WE PROVIDE THE SITE “AS IS.” TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES. HULA V3 LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SITE OR ATTENDANCE AT THE EVENT. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

Indemnification

You agree to indemnify and hold Hula V3 LLC and its affiliates harmless from all claims, liabilities, and expenses arising out of your use of the Site, purchase of tickets, or breach of these Terms.

Governing Law; Jurisdiction

The Terms shall be governed by the laws of the State of Florida. All disputes arising out of or related to your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located within Suwannee County, Florida (or the applicable district court), and you agree to submit to the personal jurisdiction of such courts.

• Assignment: Company may assign these Terms at any time without your consent.
• Severability: If any provision is found invalid, the remaining provisions remain in full force.
